Terms of Service — Orburst

1. Acceptance of Terms

By downloading, installing, or using the Orburst mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Eligibility

The App is available to users of all ages. However:

  • Users under 16 are subject to restricted functionality (no ads, no analytics) in compliance with COPPA and GDPR-K regulations.
  • Users under 13 should only use the App with parental or guardian consent.
  • By using the App, you represent that you have the legal capacity to agree to these Terms, or that your parent or guardian has agreed on your behalf.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on devices you own or control, subject to these Terms and the applicable app store terms (Apple App Store or Google Play Store).

You may not:

  • Copy, modify, distribute, sell, or lease any part of the App
  • Reverse engineer, decompile, or disassemble the App
  • Use the App for any unlawful or unauthorized purpose
  • Attempt to gain unauthorized access to any part of the App
  • Remove or alter any proprietary notices or labels on the App

4. Game Content and Progress

4.1 Local Storage

All game progress, scores, settings, unlocked themes, achievements, and quest data are stored locally on your device. We do not back up or sync your data to any server.

  • Uninstalling the App will permanently delete all your game data.
  • We are not responsible for data loss due to device failure, accidental deletion, or any other cause.

4.2 Daily Challenges

Daily challenges are the same for all players worldwide on a given day. Scores and streaks are tracked locally. We do not operate leaderboards or competitive ranking systems.

4.3 Virtual Currency (Coins)

The App includes virtual currency ("Coins") that can be earned through gameplay (quests, daily login, rewarded ads) or purchased. Coins are used to unlock themes and other in-game items. Coins:

  • Have no real-world monetary value
  • Cannot be exchanged, transferred, or refunded outside of applicable app store policies
  • Are stored locally on your device and may be lost if the App is uninstalled

5. In-App Purchases

5.1 Available Purchases

The App offers the following optional in-app purchases:

  • Remove Ads (non-consumable, one-time purchase): Permanently removes all advertisements and makes power-ups free.
  • Coin Pack (consumable): Provides a one-time grant of virtual coins.

5.2 Payment Processing

All purchases are processed through the Apple App Store or Google Play Store. We do not directly collect or store any payment information. All transactions are subject to the terms and conditions of the respective platform.

5.3 Refunds

Refund requests must be directed to the Apple App Store or Google Play Store, as they handle all payment processing. We do not process refunds directly.

5.4 Restore Purchases

Non-consumable purchases (Remove Ads) can be restored on the same platform account via the "Restore Purchases" option in the App's Settings screen.

6. Advertising

The App displays advertisements through Google AdMob, subject to your consent:

  • If consent is granted: Interstitial ads may appear after game sessions, and rewarded ads are available as an optional way to use power-ups for free.
  • If consent is denied or user is under 16: No ads are displayed.
  • If "Remove Ads" is purchased: All ads are permanently removed.

Ad frequency and format may change over time. We strive to ensure ads do not disrupt the core gameplay experience.

7. Sharing and User-Generated Content

The App allows you to share your game scores via:

  • Share Card: An image of your game results shared through your device's native share sheet.
  • Copy Score: A text-based summary copied to your clipboard.

When you share content, you are responsible for where and how you share it. We do not control third-party platforms or services you may share content to. Shared content contains only game scores and statistics — no personal information is included.

8. Intellectual Property

8.1 Our Rights

The App, including all content, features, functionality, graphics, design, gameplay mechanics, audio, and code, is owned by Made By Bang and is protected by copyright, trademark, and other intellectual property laws.

The name "Orburst," the App icon, and all associated branding are trademarks of Made By Bang.

8.2 Feedback

If you provide us with feedback, suggestions, or ideas about the App, you grant us the right to use such feedback without restriction or compensation to you.

9. Prohibited Conduct

You agree not to:

  • Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software to modify or interfere with the App
  • Misrepresent your age during the age verification process
  • Use the App in any way that could damage, disable, or impair the App or interfere with other users' enjoyment
  • Use the share feature to distribute harmful, offensive, or inappropriate content
  • Attempt to manipulate scores, in-app purchases, or game mechanics through unauthorized means

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10.2 No Guarantee of Availability

We do not guarantee that the App will be available at all times, uninterrupted, or error-free. We may modify, suspend, or discontinue the App at any time without notice.

10.3 Third-Party Services

We are not responsible for the availability, accuracy, or content of third-party services used by the App (Google Firebase, Google AdMob, Apple App Store, Google Play Store).

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MADE BY BANG BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

Our total liability for any claim arising from or relating to the App shall not exceed the amount you paid for in-app purchases in the 12 months preceding the claim, or $10 USD, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Made By Bang from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

13. Termination

We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to us, other users, or third parties.

Upon termination, your license to use the App will immediately cease. Provisions that by their nature should survive termination will survive (including Disclaimers, Limitation of Liability, and Indemnification).

14. Changes to These Terms

We may update these Terms from time to time. Changes will be reflected by an updated "Last Updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the revised Terms.

For significant changes, we will notify users through the App or its store listing.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Vietnam, without regard to conflict of law provisions.

16. Dispute Resolution

Any disputes arising from or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the applicable rules in Vietnam.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Made By Bang regarding your use of the App.
